Conversion of overdue invoices into negotiable instruments

The purpose of this procedure is to prompt the debtor to take action. By converting the debt into a Negotiable Instrument valor tittle with protest, the goal is for the debtor to either settle the debt or, at the very least, show willingness to negotiate payment. Often, debtors do not give sufficient importance to a simple invoice; however, as we know, payment priority is usually given to debts that are classified as Negotiable Instruments rather than ordinary invoices.
This procedure allows the conversion of an overdue invoice into a Negotiable Instrument and also enables the protest of the debt through a Certificate of Ownership (Constancia de Titularidad). With this document, the debt acquires the same legal weight as a bill of exchange, promissory note, check, or any other Negotiable Instrument, thereby making the debt eligible to initiate an executive judicial process—a highly efficient and expeditious method of debt collection, should the decision be made to escalate the Certificate of Ownership to judicial enforcement.
